Creditors' Rights & Banking

Kilmer, Voorhees and Laurick represent several community, regional and national banking organizations; leasing companies; and other creditors on the many issues they encounter in their businesses including litigation, workouts and bankruptcies. This includes all aspects of creditors’ right and remedies such as real property judicial and nonjudicial foreclosures, personal property foreclosures, replevins and recoveries, general recovery matters, UCC actions under Articles 2A and 9, prejudgment and provisional process action, and bankruptcy claims litigation. We have extensive litigation experience including jury and bench trials and arbitrations/mediations in these and other litigation areas. We also have defended numerous claims involving banks on such issues as conversion of checks under UCC Articles 3 and 4, priority disputes under UCC Article 9 as well as priority disputes involving real property and construction liens. These litigation activities include state, federal and bankruptcy courts located in Oregon and Washington.
